Terms and Conditions
1. Agreement to these Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Android application Smart Launcher & AI Tools (package Smart.Launcher.AI.Tools) (“App,” “we,” “us,” or “our”), including its launcher features and built-in tools (gallery, downloader hub, AI tools, browser, files, clock, calculator, notepad, recorder, and related features).
By downloading, installing, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not install or use the App; uninstall it immediately.
2. Eligibility
- You must be able to form a binding contract under applicable law.
- You must meet Google Play’s age requirements for the App’s content rating.
- The App is not directed to children under 13. If you are under the digital consent age in your country, you may use the App only with a parent/guardian’s involvement as required by law.
3. License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, solely for personal, lawful purposes, subject to these Terms and Google Play’s terms.
You may not:
- Copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract source code of the App, except to the extent such restriction is prohibited by law;
- Remove proprietary notices;
- Use the App to build a competing product by systematically scraping its UI or non-public interfaces;
- Bypass security, licensing, ads, or access controls;
- Use the App in any way that violates Google Play Developer Program Policies, applicable law, or third-party rights.
4. Description of the App
The App may provide, among other things:
- Home launcher: home screens, app drawer, dock, folders, widgets, wallpaper, and app launch/uninstall helpers;
- Video / media downloader hub: tools to resolve and save media from URLs you provide, WebView shortcuts, download history, and related utilities;
- Gallery & editors: browse device media; photo/video editing; collage; background remover; hidden vault;
- AI tools: caption and hashtag generation (may use third-party AI APIs);
- Productivity tools: notepad/todos with reminders, calculator, files manager, browser, voice recorder;
- Clock: alarms, timers, and related notifications/full-screen intents;
- Smart features: weather and other hub cards that may use location;
- Advertising: free functionality supported by ads (AdMob).
Features may change, be limited by device OS version/permissions, or depend on third-party services. We may add, modify, or discontinue features without liability.
5. Default home app
Setting the App as your default Home/launcher is optional and controlled by Android system settings. You can change the default launcher at any time. We are not responsible for loss of access to other launchers or for system behavior after you change defaults.
6. Accounts
The App does not require a dedicated account with us. If you sign into third-party websites inside WebView/Browser (for example social networks), that relationship is solely between you and that third party.
7. User content and local data
“User Content” means notes, todos, recordings, photos/videos you edit, downloads, vault items, browser data, home layouts, and any other content you create or store using the App.
- You retain ownership of your User Content.
- You are responsible for backing up important User Content. Uninstalling or clearing data may permanently delete it.
- You grant us a limited permission to process User Content only as needed to provide features you request (for example sending an image you select to an AI API for captions).
8. Acceptable use
You agree not to use the App to:
- Violate any law, regulation, or third-party right (including copyright, trademark, privacy, or publicity rights);
- Harass, abuse, defame, or harm others;
- Distribute malware, spam, or phishing content;
- Attempt unauthorized access to networks, devices, or accounts;
- Interfere with ads, analytics, or security mechanisms;
- Use automation to overload our or third-party APIs;
- Misrepresent your identity or the source of content;
- Use download or scraping features in breach of a platform’s terms of service.
9. Copyright, media downloading, and intellectual property (critical)
9.1 Our IP
The App’s software, design, trademarks, icons, and documentation are owned by us or our licensors. Third-party libraries (for example AndroidX, Google Play services, OpenCV, Coil, Media3, Retrofit/OkHttp, Firebase) remain owned by their respective owners and are used under their licenses.
9.2 Your responsibility for downloaded / accessed content
Download, WebView, browser, repost, and similar features may allow you to access or save media from URLs or websites you choose. You alone are responsible for ensuring that your use is lawful and authorized.
You represent and warrant that:
- You own the content, or have permission / a legal right (including fair use where applicable) to download, copy, modify, or share it;
- Your use complies with the terms of Instagram, Facebook, TikTok, YouTube, X, WhatsApp Web, Telegram Web, and any other platform you access;
- You will not use the App to infringe copyright, circumvent DRM/technical protection measures, or pirate content;
- You will not use downloaded content for unauthorized commercial redistribution.
The App provides a technical tool only. We do not grant you any license to third-party content. We do not encourage copyright infringement. If you are unsure whether you have rights to content, do not download or share it.
9.3 DMCA / copyright complaints
If you believe content associated with the App infringes your copyright, contact us at smartlauncheraitools@gmail.com with: (a) your contact details; (b) description of the work; (c) description of the allegedly infringing material; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that you are authorized to act; and (f) your physical or electronic signature. We may remove or disable access to disputed material and/or terminate repeat infringers’ access where appropriate.
10. AI features
AI caption and hashtag tools may send images you select to third-party AI providers (including OpenAI). AI outputs may be inaccurate, incomplete, biased, or unsuitable. You must review outputs before publishing. Do not submit images of others without rights/consent where required. Do not submit illegal content. AI features may fail if API keys/quota/network are unavailable.
11. Advertising
The App is ad-supported. Ads may be served by Google AdMob and related partners. Ads may appear between screens, on banners, as interstitials, native units, or other formats. We may use remote configuration to update ad placements/IDs.
- You agree that ads are part of the free App experience.
- We are not responsible for third-party advertiser websites, products, or landing pages.
- Attempting to block, click-fraud, or manipulate ads may result in limited functionality or termination of license.
12. Third-party services
The App depends on third parties such as Google Play services, AdMob, Firebase, OpenAI, RapidAPI/media APIs, ipinfo.io, Open-Meteo, and websites you open. Their availability, accuracy, and policies are outside our control. Your use of those services may be subject to additional terms.
13. Permissions
The App requests Android permissions described in our Privacy Policy (storage/media, microphone, location, notifications, alarms, biometric, internet, etc.). Refusing permissions may disable related features. You are responsible for granting only permissions you understand.
14. Privacy
Our data practices are described in the Privacy Policy, which is incorporated into these Terms by reference.
15. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
- The App will be uninterrupted, secure, or error-free;
- Downloads, AI outputs, weather, or alarms will be accurate or available at all times;
- Defects will be corrected;
- The App is free of harmful components from third-party networks (though we aim to use reputable SDKs).
Launcher apps interact deeply with the Android system. We are not responsible for OEM-specific launcher quirks, battery optimizations that kill alarms, or OS changes that break features.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR DEVELOPERS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OFTEN ZERO FOR A FREE APP), OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, developers, and partners from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: (a) your User Content; (b) your misuse of download/AI/WebView features; (c) your violation of these Terms; (d) your infringement of third-party rights; or (e) your violation of platform terms or law.
18. Google Play and device terms
Your use of the App must also comply with the Google Play Terms of Service and Google Play Developer distribution rules applicable to users. If these Terms conflict with mandatory Google Play terms for Play-distributed apps, the Google Play terms control to the extent of the conflict for distribution via Play.
19. Updates and changes
We may release updates that automatically modify the App. You agree that updates may be required for continued use. We may modify these Terms by posting an updated version at the Terms URL and changing the “Last updated” date. Continued use after changes constitutes acceptance.
20. Suspension and termination
We may suspend or terminate your license to use the App if you violate these Terms, abuse APIs/ads, or create legal risk. You may stop using the App at any time by uninstalling it. Sections that by nature should survive (IP, disclaimers, liability limits, indemnity, copyright) will survive termination.
21. Export and sanctions compliance
You represent that you are not located in a country subject to comprehensive embargoes applicable to the App’s technologies and are not a prohibited party under applicable export/sanctions laws.
22. Governing law and disputes
To the extent permitted by law, these Terms are governed by the laws applicable in the developer’s primary place of business, without regard to conflict-of-law rules. Courts in that venue will have exclusive jurisdiction, except where consumer protection laws in your country require otherwise (mandatory consumer rights remain available).
Before filing a claim, you agree to contact us and attempt informal resolution within 30 days.
23. Severability and entire agreement
If any provision is unenforceable, the remaining provisions remain in effect. These Terms plus the Privacy Policy are the entire agreement regarding the App and supersede prior understandings about the App.
